Does Virtual Contrast Supervision Comply with CMS Regulations?
Absolutely. In response to the COVID-19 Public Health Emergency, CMS revised its policies in April 2020, including the definition of direct supervision in the "Policy and Regulatory Revisions" publication. This revision now encompasses virtual presence via real-time audio/video communication technology, specifically allowing for the direct supervision of contrast-enhanced examinations, provided that the communication is not audio-only. The 2024 Medicare Physician Fee Schedule (MPFS) Proposed Rule, issued in August 2023, and the MPFS Final Rule, published in November 2023, both reaffirm this expanded definition. According to the Final Rule, virtual supervision using real-time audio/video communications will continue to satisfy CMS's requirements for direct supervision until at least December 31, 2024.
